Are all Flex's 50 state emissions legal?

Hi,
I live in the Bay Area, and want to buy a Flex. However, I found the one with the packages I want out of state. Does anyone know if all Flex's were manufactured to meet 50 state emissions standards?

The Flex is/was sold with two different emissions configurations. I don't know what the hardware differences are, it might just be a reprogram of the computer.
